INFORMATION WE COLLECT

Personal Information As part of the registration process, we collect some personal and contact information from those who use the Services, including but not limited to names, addresses, email addresses, telephone numbers, photographs, usernames and passwords (“Personal Information”). We may share such Personal Information with certain affiliates, business partners and other users of the Services, as the case may be.

Physical Fitness Information. As part of the registration process and continuous use of the Service, we collect various items of physical fitness information from those who use the Services, including but not limited to weight, age, gender and fitness activities (“Fitness Information”).

Automated Information. When you access or use the Website or the Services, we may automatically collect certain information about you and your computing device, including, without limitation, your computer’s or mobile device’s internet protocol address, browser type and operating system that you use, your internet service provider or mobile carrier and the type of handheld or mobile device that you use, the names and URLs of pages you visited, the browser and operating system of your computer as well as the name of your access provider. We may also collect information about how you access or use the Website or the Services, including, without limitation, (i) the date and time that you access or use the Website or the Services, the webpage or application you were visiting before accessing the Website or Services, pages that you visit on the Website (and, if you link to another website, the address of that website), the parts of the Website or the Services that you use, information for which you search, content that you view and actions that you take on or through the Website or the Services, and other statistics, (ii) emails you open and links you click within those emails, and (iii) how you view and interact with other users of the Services, content or advertisements on or through the Website or the Services. Location Information We may collect physical location information that is sufficiently precise to allow us to locate a specific person or device (“Location Information”).

By accessing our Website or Services, you agree that we have permission to collect and store your Location Information.

Communication Information. If you communicate with other users of the Services through the Services, you provide us the content of your communications, and if you contact us with a customer service or other inquiry, you provide us with the content of that communication (such information being collectively referred to as “Communication Information” and, together with Personal Information, Fitness Information, Automated Information, Location Information and any other information that we obtain from you through your access or use of the Website or the Services, “Information”).

Children’s Information. We do not knowingly collect any information from children under the age of 18. If a parent or legal guardian becomes aware that his or her child is using our services, or has provided us with any personally identifiable information, he or she should contact us at info@sportme.com. If we become aware that a child under 18 has provided us with any personally identifiable information, we will promptly delete such information along with the child’s account.

Feedback. We very much appreciate feedback from our customers; by providing feedback, including any review posted in the app store, unless explicitly stated otherwise, you hereby give your consent for SportMe to republish or reuse the review in our marketing materials, along with the first name and last initial of the name under which you sent the feedback or published the review. HOW WE USE INFORMATION WE COLLECT

The data we collect is processed by us for the following general purposes:

To ensure a proper connection to our Website; to ensure an outstanding user experience of our website; to evaluate our system security and stability; and for additional administrative purposes.

HOW WE COLLECT INFORMATION

We may use certain data technologies to collect information, including, without limitation Cookies (as defined below), Local Storage (as defined below) and Pixel Tags (as defined below). “Cookies” are small data files stored on your hard drive by a website. INTERNET COOKIES

We use cookies on our site. These are small files that your browser automatically creates and displays on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not harm your device, do not contain viruses, Trojans, or other malicious software. The cookies store information regarding the connection with the specific terminal used. This does not, however, mean that we are immediately aware of your personal identity or household identity. The use of cookies serves to give you a better user experience. For example, we use session cookies to recognize that you have already visited individual pages on our website. Session cookies are automatically deleted after leaving our page. In addition, to improve the user experience, we use temporary cookies that are stored on your device for a predetermined period of time, typically 30 days. If you visit our site again to take advantage of our services, our system will automatically recognize that you have visited us, and will remember the inputs and settings you made so you do not have to re-enter them. We also use cookies to record the statistics around the use of our website, and to evaluate those statistics for the purpose of optimizing the Services. AD TRACKING AND THIRD-PARTY ANALYTICS

We employ various types of ad tracking and analytics tools to help us provide you with appropriate services. Those tools can include Mixpanel, Google Analytics, Firebase, Google AdWords, and Facebook Tracker. The information we share is anonymized by these third parties and the anonymized information is included in feedback we receive. These third-party services may change from time to time, and by accessing the Services, you give your consent to your information be included in these services.

In addition we use iOS Ad Tracking. iOS Ad Tracking enables the use of the Advertising Identifier, a non-permanent device identifier, for apps to give you more control over advertisers’ ability to serve you targeted ads. If you choose to limit ad tracking, we will not serve you targeted ads. You can reset a device’s Advertising Identifier at any time. Additionally, iAd will opt your Apple ID out of receiving ads targeted to your interests regardless of what device you are using. Please note: by turning Limit Ad Tracking “on” you may still see the same number of ads as before, but they may be less relevant because they will not be based on your interests.

We collect the following categories of your personal information and may sell it to third parties: identifiers, commercial information, internet or other electronic network activity information, geolocation data, and inferences drawn from these categories.

THIRD-PARTY DATA PROCESSING.

We collect and process your data to facilitate your use of the Website and Services. This third-party data process impacts any data you gave us to sign up for your account, including (but not limited to) the following: Your name; Your address; Your phone number; Your email address; Your job title (if specified); and Payment information, such as Your bank account or credit card information (if applicable).

Your personal data will only be passed on to third-parties or otherwise transmitted if this is necessary for the purpose of contract execution or billing or if you have previously consented. For example, in the context of order processing, the service providers used here (such as PayPal or banks) the necessary data to handle the order and order process. The data transmitted in this way may only be used by our service providers to fulfill their task. Any other use of the information is not permitted We need the correct name, address, contact and payment details to process your order. We need your email address so that we can confirm the order and communicate with you. Furthermore, you will receive the order confirmation and invoice via your email address. Employer and job title information is required to ensure services such as support and follow-up can be properly provided.

The legal basis for the data processing described in this section is the fulfillment of our contractual obligations.

DATA STORAGE

We store personal data only as long as necessary to fulfill the contractual or legal obligation for which we have collected the data. Thereafter, we delete the data.

Notwithstanding the above statement on data storage, for legal purposes, we may retain contract information for three years from the end of the year in which the business relationship ends with you, and we may sometimes save your data for longer periods of time for accounting reasons.

APPLICATIONS, WIDGETS AND SOCIAL MEDIA

We may include applications or widgets from social media providers that allow interaction or content sharing by their users. These widgets, such as a Facebook "Share" or "Like" button, are visible to you on the web page or other area of the Services you visit or interact with. Integration between the Website and social media networks such as Facebook, Twitter and others may allow social media networks in which you participate to collect information about you, even when you do not explicitly activate such network’s application or widget. Please visit the applicable social media network’s privacy policy to better understand their data collection practices and choices they make available to you. The privacy policy of the social media network controls the collection, use and disclosure of all personal information transmitted to such network.

The Website or other Services may contain links to other websites or applications not operated by us, as well as third party widgets and applications discussed above. Once you leave the Services, we suggest that you review the applicable privacy policy of the third-party website or application. We are not responsible for the content or use of any websites or applications other than on the Website and Services or the privacy practices of such other websites or applications.

SECURITY

We employ reasonable physical, technological and administrative security measures to protect all Personal Information from unauthorized access to or alteration of such Personal Information. In order to comply with any request, we may ask you to verify your identity. We will fulfill your request by sending a copy of your information electronically, unless the request expressly specifies a different method. For any subsequent access request, we may charge you an administrative fee. Any data that is no longer needed for the purposes specified in this policy will be deleted on a periodic basis. You do not need to provide us with a specific reason for your request.

Demand the deletion of your personal data stored by us, unless the processing for the exercise of the right to freedom of expression and information, for the fulfillment of a legal obligation, for reasons of public interest or for the assertion, exercise or defense of Legal claims is required;
Demand the restriction of storing and/or processing your personal data. You can exercise a defense of your legal claims where you have objected to the data processing in accordance with Art. 21 GDPR;
Receive your personal data provided to us in a structured, standard and machine-readable format or to request transmission to another person responsible;
Revoke your once given consent to us at any time. If you revoke your consent, we are not allowed to continue the data processing based on this consent cancellation, and this action may impact our ability to provide services to you.
